FIRST SECTION

Identity and address of the Responsible Party.

In accordance with Article 15 of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), AUTOMOTIVE CLUSTER OF SAN LUIS POTOSÍ A.C. (hereinafter “AUTOMOTIVE CLUSTER SLP”), located at Av. Paseo de los Derechos Humanos, Colonia Sierra Leona, San Luis Potosí, S.L.P. C.P. 78210, informs you of this Privacy Notice.

SECOND SECTION

Personal Data and Sensitive Data subject to processing.

AUTOMOTIVE CLUSTER SLP, as part of its activities, collects and processes personal data directly from the data subject or from authorized sources, with the purpose of fulfilling the purposes indicated in this Privacy Notice.

The Personal Data processed by AUTOMOTIVE CLUSTER SLP includes, for clients and/or suppliers: identification data, addresses, tax information, contact details, personal references, credit, commercial, and financial information. For associates of the Automotive Cluster SLP, data collected includes name, company, position, email address, telephone numbers, RFC, business type, number of employees, and approximate annual sales. For visitors to internet portals, identification and contact information is obtained.

AUTOMOTIVE CLUSTER SLP commits to treating sensitive data under strict security measures, ensuring confidentiality.

In specific cases, consent is not required for the processing of Personal Data when it is provided for by law, is publicly available, undergoes prior dissociation, aims to fulfill obligations derived from a legal relationship, there is a potential emergency harming an individual’s property or person, or there is a resolution from a competent authority.

THIRD SECTION

Purposes of the processing.

The primary purposes of processing Personal Data by AUTOMOTIVE CLUSTER SLP include verifying identity, preparing proposals, commercial contracting, sharing information, contracting services, conducting procedures before authorities, keeping databases updated, managing payments and collection of services, evaluating product and service quality and satisfaction, among others.

FOURTH SECTION

Transfer of personal data.

The data subject understands and authorizes AUTOMOTIVE CLUSTER SLP to transfer data to third parties, always respecting the purposes of this Privacy Notice. AUTOMOTIVE CLUSTER SLP does not transfer Sensitive, Patrimonial, or Financial Personal Data without explicit written consent from the Data Subject.

FIFTH SECTION

Means and procedure to exercise ARCO rights.

The data subject may exercise their ARCO rights (Access, Rectification, Cancellation, and Opposition) and limit the use or disclosure or request the revocation of consent by sending a written request to AUTOMOTIVE CLUSTER SLP at administracion@clusterautomotrizslp.com.

The request must include the name of the data subject, address, documents proving identity, a clear description of the Personal Data to be exercised, and any other information necessary. AUTOMOTIVE CLUSTER SLP will respond within 20 business days.

In case of insufficient requests, AUTOMOTIVE CLUSTER SLP will request additional documentation within 5 business days. The response will be notified electronically.

SIXTH SECTION

Mechanisms and procedures to revoke consent.

AUTOMOTIVE CLUSTER SLP is authorized to process Personal Data in accordance with the purposes and may continue processing until receiving the negative response from the data subject. To communicate the negative response, the data subject must follow the procedure established for exercising ARCO rights.

SEVENTH SECTION

Options to limit use or disclosure.

To fulfill the purposes of this Privacy Notice and process Personal Data, AUTOMOTIVE CLUSTER SLP may deliver all or part of the Personal Data to third parties, including individuals or legal entities, national or foreign, subsidiary companies or suppliers of goods or services. These entities will be contractually obliged to maintain the confidentiality of Personal Data and comply with the provisions of this Privacy Notice. To request a limitation on use or disclosure, the data subject must follow the procedure for exercising ARCO rights.

EIGHTH SECTION

Communication through the use of Cookies, Web Beacons, or similar.

If the data subject provides their Personal Data through electronic means (portal), they understand, accept, and acknowledge that:

• Links to third-party websites may be included, for which AUTOMOTIVE CLUSTER assumes no responsibility.
• Links to social media sites may be included, and the data subject accepts that providing any information on those sites may be read, viewed, accessed, retransmitted, and processed by anyone, releasing AUTOMOTIVE CLUSTER SLP from any liability.

Cookies: These are data files stored on the hard drive of the user’s computer or electronic communication device when browsing a specific website, which allows the exchange of state information between that site and the user’s browser. State information may reveal session identification, authentication, or user preferences, as well as any other data stored by the browser regarding the website.

Web beacons: These consist of visible or hidden images inserted within a website or email, used to monitor user behavior on these media. Through these, information such as the original IP address, browser used, operating system, time of access to the page, and, in the case of email, the association of the above data with the recipient can be obtained. AUTOMOTIVE CLUSTER SLP may use cookies or web beacons to facilitate navigation and achieve greater efficiency by customizing the services offered to visitors on its portal. The cookies or web beacons used do not provide references that allow deducing the name and surnames of the visitor, and they cannot read data from their hard drive or include viruses in their texts. This Privacy Notice may undergo modifications, changes, or updates due to new legal requirements, the needs of AUTOMOTIVE CLUSTER SLP for the products or services it offers, the privacy practices of AUTOMOTIVE CLUSTER SLP, changes in the business model of AUTOMOTIVE CLUSTER SLP, or other reasons.
